Warranty

1. Warranty coverage

1.1. The Product is covered by a limited warranty for 12 months from the original date of purchase.

1.2. The Product's supplied battery is covered for 12 months from the original date of purchase.

1.3. Any charger supplied with the Product is covered for 12 months from the original date of purchase.

1.4. This limited warranty covers defects in materials and workmanship arising during normal and intended use of the Product.

1.5. The warranty period begins on the date shown on the Customer's proof of purchase.

1.6. This limited warranty applies to the original purchaser and is not transferable, except where otherwise required by applicable law.

1.7. This limited warranty is provided in addition to any rights and remedies the Customer may have under applicable New Zealand or Australian consumer law.

2. Warranty exclusions

Subject to the Customer's rights under applicable consumer law, this limited warranty does not cover:

2.1. Consumable items and accessories, including welding tips, nozzles, electrodes, contact tips, earth clamps, welding leads and other items subject to normal wear and tear, unless the item was defective when supplied.

2.2. Cosmetic damage that does not affect the safe or proper operation of the Product.

2.3. Normal wear and tear or gradual deterioration resulting from the Product's expected use.

2.4. Damage, failure or malfunction caused or contributed to by:

  • Misuse, abuse, negligence or neglect.
  • Operating the Product outside its intended purpose, specifications or rated capacity.
  • Exceeding the Product's stated duty cycle.
  • Failure to follow the operating, charging, storage, safety or maintenance instructions.
  • Improper setup, installation, maintenance or repair.
  • Accidents, impact, crushing, dropping or excessive vibration.
  • Water or moisture ingress.
  • Fire, excessive heat, corrosion, contamination or metal debris.
  • Use in unsuitable environmental conditions.
  • Unauthorized modifications, disassembly or repairs.
  • Use of incompatible accessories, chargers, power supplies or replacement parts.
  • Power surges, incorrect input voltage or other external electrical faults.
  • Continued use after the Product develops a suspected fault where that continued use causes further damage.

2.5. Products with a serial number that has been removed, altered, obscured or tampered with.

2.6. Loss or damage during return transportation caused by inadequate packaging.

2.7. Products that cannot be reasonably identified or matched to valid proof of purchase, subject to applicable consumer law.

3. Battery exclusions and care requirements

3.1. Subject to the Customer's rights under applicable consumer law, the limited battery warranty does not cover battery failure, damage, deterioration or excessive loss of capacity caused or contributed to by misuse, negligence, improper charging, inadequate maintenance or improper storage.

3.2. Examples of excluded battery neglect or misuse include:

  • Allowing the battery to become excessively or fully discharged and failing to recharge it within the period recommended in the user manual.
  • Leaving the battery in a discharged state for an extended period.
  • Failing to periodically recharge the battery while the Product is in storage.
  • Storing the Product for an extended period with an insufficient battery charge.
  • Using an incorrect, incompatible or damaged charger.
  • Charging or storing the battery outside its recommended temperature range.
  • Exposing the battery to excessive heat, fire, water, moisture, corrosion or physical damage.
  • Continuing to operate the Product after receiving a low-battery or battery-fault warning.
  • Failing to follow the battery charging, maintenance and storage instructions supplied with the Product.

3.3. Battery runtime and maximum capacity will gradually reduce through normal use and ageing. Gradual capacity reduction consistent with the battery's age, usage and number of charging cycles is not considered a manufacturing defect under this limited warranty.

3.4. A battery claim will not be declined solely because the battery has failed or lost capacity. Forgeworks Supply Co may inspect and test the battery to establish whether the failure resulted from:

  • A defect in materials or workmanship.
  • Normal battery ageing and deterioration.
  • Excessive discharge.
  • Improper charging or storage.
  • Physical, thermal or moisture damage.
  • Another excluded cause.

3.5. A battery exclusion will only be relied upon where Forgeworks Supply Co reasonably determines that the excluded condition caused or materially contributed to the battery failure or damage.

3.6. These battery exclusions apply to this voluntary limited warranty and do not exclude any rights that the Customer may have under applicable consumer law.

4. Customer maintenance responsibilities

4.1. The Customer is responsible for operating, charging, storing, cleaning and maintaining the Product in accordance with the manufacturer's user manual and battery-care instructions.

4.2. Reasonable Product maintenance includes:

  • Keeping the Product clean and dry.
  • Protecting it from welding dust, grinding debris and metal particles.
  • Inspecting welding leads, terminals, connectors and charging equipment.
  • Keeping connections secure, clean and free from corrosion.
  • Using the correct charger and power supply.
  • Charging the battery at the recommended intervals.
  • Storing the Product at the recommended charge level.
  • Storing the Product within its recommended temperature and environmental conditions.
  • Stopping use if the Product becomes damaged, unsafe or develops a suspected fault.

4.3. A failure to undertake reasonable maintenance will only affect warranty coverage where that failure caused or materially contributed to the claimed fault or damage.

5. Warranty claim process

5.1. To make a claim under this limited warranty, the Customer must contact Forgeworks Supply Co using the contact details shown at the beginning of this document.

5.2. The Customer should make the claim within the applicable warranty period and within a reasonable period after becoming aware of the suspected fault.

5.3. The Customer must provide:

  • Proof of purchase showing the original purchase date.
  • The Product's model and serial number.
  • A description of the suspected fault.
  • Details of how and when the fault occurred.
  • Photographs, videos or other information reasonably required to assess the claim.

5.4. If continued operation could be unsafe or cause further damage, the Customer must stop using the Product immediately.

5.5. Forgeworks Supply Co may undertake preliminary troubleshooting before requiring the Product to be returned.

5.6. Forgeworks Supply Co may require the Product, charger, battery and relevant accessories to be returned to a nominated service location for inspection and testing.

5.7. Proof of purchase may include an invoice, receipt, order confirmation, bank statement or other reasonable evidence of the purchase.

6. Return freight and packaging

6.1. Before returning the Product, the Customer must contact Forgeworks Supply Co and follow the return instructions provided.

6.2. Unless Forgeworks Supply Co arranges collection, the Customer may initially be required to arrange and pay for return freight.

6.3. If inspection confirms that the fault is covered by this limited warranty or applicable consumer law, Forgeworks Supply Co will reimburse reasonable return-freight costs upon receiving suitable evidence of those costs, where required by law.

6.4. Where applicable consumer law requires Forgeworks Supply Co to arrange collection or bear the return costs, Forgeworks Supply Co will do so.

6.5. The Product should be returned in its original packaging or other packaging that provides equivalent protection. Original packaging is not mandatory for a claim, but the Customer is responsible for packaging the Product appropriately.

6.6. Subject to applicable consumer law, Forgeworks Supply Co is not responsible for additional damage caused by inadequate packaging or unreasonable freight arrangements organized by the Customer.

6.7. If inspection establishes that the Product is not faulty or that the damage resulted from an excluded cause, Forgeworks Supply Co may charge reasonable assessment, repair and freight costs. The Customer will be advised of these costs before any chargeable repair is completed.

7. Assessment and remedies

7.1. Forgeworks Supply Co or its authorized service provider may inspect and test the Product to determine the nature and cause of the fault.

7.2. If the fault is covered by this limited warranty, Forgeworks Supply Co may:

  • Repair the Product.
  • Replace the defective component.
  • Replace the Product with the same or an equivalent product.
  • Provide another remedy agreed with the Customer.

7.3. Forgeworks Supply Co's choice of remedy under this voluntary limited warranty is subject to any remedy the Customer is entitled to choose under applicable consumer law.

7.4. Replacement parts or Products may be new or refurbished, provided they are of equivalent quality, condition and functionality where permitted by law.

7.5. Repaired or replaced parts supplied under this limited warranty will be covered for the remainder of the original warranty period or 90 days from the repair or replacement date, whichever is longer.

7.6. Repairs or replacements provided under applicable consumer law remain subject to the rights and remedies provided by that law.

7.7. If inspection determines that the fault or damage is not covered, Forgeworks Supply Co may provide a quotation for repair, replacement parts, assessment and freight. No chargeable repair will be undertaken without the Customer's approval.

8. New Zealand consumer rights

8.1. For Products supplied in New Zealand, this limited warranty is additional to any rights and remedies available under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 and other applicable New Zealand legislation.

8.2. Nothing in this warranty excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

8.3. Rights under the Consumer Guarantees Act may continue beyond the stated limited-warranty period where the Act applies.

8.4. Where the Product is acquired for business purposes, the parties agree that the Consumer Guarantees Act 1993 will not apply, provided that:

  • The agreement to contract out is recorded in writing.
  • The Product is supplied and acquired in trade.
  • Contracting out is fair and reasonable.
  • Contracting out is otherwise permitted by law.

9. Australian consumer rights

9.1. For Products supplied in Australia, this limited warranty is provided in addition to the rights and remedies available under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9.2. Nothing in this warranty excludes, restricts or modifies any consumer guarantee, right, remedy or liability under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

9.3. The benefits provided by this limited warranty are additional to the Customer's other rights and remedies under the Australian Consumer Law.

9.4. Australian consumer guarantees may continue to apply beyond the stated limited-warranty period.

9.5. The exclusions in this document, including the battery-neglect exclusions, apply to the voluntary limited warranty only. They do not exclude rights or remedies available under the Australian Consumer Law.

10. Limitation of liability

10.1. Subject to applicable consumer law, Forgeworks Supply Co's liability under this voluntary limited warranty is limited to repairing or replacing the defective Product or component.

10.2. To the maximum extent permitted by law, Forgeworks Supply Co will not be liable for indirect, incidental, special or consequential losses, including:

  • Loss of use.
  • Loss of income or profit.
  • Loss of production.
  • Business interruption.
  • Loss of contracts.
  • Damage to other equipment or property.
  • Third-party claims.

10.3. These limitations do not apply where the loss or liability cannot lawfully be excluded or limited, including compensation available for reasonably foreseeable loss or damage under the Australian Consumer Law.

10.4. To the maximum extent permitted by law, Forgeworks Supply Co's total liability arising under this voluntary limited warranty will not exceed the original purchase price of the affected Product.

10.5. Nothing in this section limits any statutory remedy or liability that cannot lawfully be limited.

11. Product performance

11.1. Statements concerning welding output, operating time, battery runtime, charging time or duty cycle are based on specified testing or operating conditions.

11.2. Actual performance may vary depending on factors including:

  • Welding settings and process.
  • Electrode or wire type and size.
  • Material type and thickness.
  • Ambient temperature.
  • Battery temperature, condition and charge level.
  • Operating technique.
  • Product maintenance.
  • Frequency and duration of use.

11.3. Normal differences in performance resulting from these operating factors do not necessarily indicate that the Product is defective.

12. General conditions

12.1. The Customer must operate the Product in accordance with:

  • The manufacturer's user manual.
  • The battery charging and storage instructions.
  • Product warning labels.
  • Applicable workplace, electrical and welding-safety requirements.

12.2. Forgeworks Supply Co may update these warranty terms from time to time. An update will not retrospectively reduce the warranty coverage applying to a Product already purchased.

12.3. If any provision of these terms is invalid or unenforceable, that provision will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.

12.4. No employee, reseller, distributor or representative may modify this warranty unless the modification is confirmed in writing by an authorized representative of Forgeworks Supply Co.

12.5. By purchasing and using the Product, the Customer acknowledges these warranty conditions. This acknowledgement does not limit any rights that cannot lawfully be excluded.
